Legal Question in Family Law in California

divorce

I want to get a divorce, but don't know where my husband is at the moment. Can I still get a divorce w/o serving him the legal paper work?

In a general sense, you have to serve him. Under certain circumstances, you can obtain permission to serve him by publication in a newspaper.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

Re: divorce

Your attorney may advise you that you need to serve him by publication. Civil Code of Procedure section 415.5 can be looked up on this website under "research tools" if you want more information. I would do everything to find him, though, to prevent the risk of a motion to set aside.
