Legal Question in Family Law in California
I want to divorce my husband of 24 years. He would not dispute it, if he were to know about it, but he is homeless and has no permanent residence or employment. Because of this, I have no way to have him served with the papers, a requirement of California divorce law.
I understand there is something called divorce "by publication", but that would add an extra $400 to the cost of my divorce if it were to be used.
Someone told me if I have the divorce papers served on one of his brothers, that would constitute legal service. Of course, the extra $400 charge would not apply in this instance. If this true, how can I make this happen?

He may be served by leaving the documents with a person over 18 at his residence or place of business. Ask his family to help you find him. If that does not work, you can try offering him $50 or more to come to a specified location. When he arrives have him served and then give him the money. This would be cheaper than paying for service by publication.
