Legal Question in Family Law in California

Divorce, Inheritance

My husband and I have been married 31 years. I am seriously considering a divorce. If his mother dies before the divorce is the inheritance community property? I assume that I have no right to any inheritance if she dies after the disolution is final or even filed?

Re: Divorce, Inheritance

In a general sense, inheritance is considered separate property. It can become community property over time, depending upon the circumstances.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
