Legal Question in Family Law in California

divorce issues

thanks in advance - together 4 years. married only 6 months. two kids, 3 and 1. i work and pay all bills. she works nights for spending money. she's seeing another man and tells me she wants a divorce. house is in my name only. do i need her to do a quit claim deed to protect my house ? credit cards only in her name, but my income is listed on the credit app's. am i responsible for the credit cards in anyway ? can i require a background check before her boyfriend meets my kids ? can she waive child support in an MSA if i have full physical custody and give her ''reasonable visitation''?

Re: divorce issues

The only way to really answer your questions would be to meet with you and find out some details. Just because something is in the name of only one spouse doesn't really mean much. I will give you a free 30 minute consultation.

Re: divorce issues

You probably don't need a quit claim deed, but it wouldn't hurt to have one. You have many issues that are too complex to deal with by e-mail. Your answers to questions will only raise more questions. You have some legitimate questions and rights. Get a consultation with an attorney, maybe with two or more attorney's so you can pick the one that will work best with you. Don't get one that just tells you what you want to hear or don't necessarily get the one that is cheapest, just one with experience and practical advice. You sound like you are in pretty good shape legally, but you'll need some guidance to get through the legal jungle. Good Luck, Pat McCrary
