in my divorce my 401k was to be split my divorce was a year ago and my ex's attorney in the divorce was to handle this but its not done can I sue her for not doing what I have already paid her for

No. She is not your attorney and you have no right to sue her. What you do have a right to do is have your ex held in contempt for failure to comply with the divorce decree. It's between your ex and your ex's attorney who faces the music for that.
