File the petition in California in the county in which you have resided for the past 90 days. Then mail the summons, petition for dissolution, and a response to him. Include in this packet a Waiver and Acknowledgment, with a self addressed stamped envelope, first class postage paid. The earliest that you can obtain a divorce is 6 months after the date he is served with the summons and petition. You will also have to prepare and mail a copy of your property declaration to him. This document must set forth all assets. To increase your chances of success you should retain an attorney. Service of the summons in a foriegn must comply with the requirements of California and the Country in which he is residing. The children are residing in the forgien and the laws of the country would probably control on that issue. California law provides for child support only until a child is 18 or 19 if a full time student in high school.
