Legal Question in Family Law in California
Divorce and Lease Agreement
I have been married to my husband for about three months. He is in the navy, but training in another state. We are in the process of getting a divorce, because things are not what they seem to be. I have a couple of questions to ask. Can he file for an anullment or divorce in the state of Maine where is working eventhough we were married in the state of California. Also we just signed a 6 month lease with the a military housing management company. He signed the allotement papers and everything for the lease. He says that he is going try to get an anullement in Maine and as soon as that is processed is going to call DFAS and stop the allotment, so me and my daughter can be evicted from the house and have now where to go. Can a spouse breach a lease agreement due to divorce right away?

Re: Divorce and Lease Agreement
file for a dissolution of marriage in Califirnia as soon as possible. That is when you have resided in California for 6 months and the county for 90 days. It will take at least 6 months after he is served with a copy of the summons and petition. This would be after the lease runs out and you would have time to find another place to live.
