Legal Question in Family Law in California

Divorce vs Legal Separation

I heard there is a 6-month waiting period for the court to approve a divorce. Is there a waiting period for a legal separation? Typically, how long does it take for a legal separation filing to take effect?

There are too many variables to give you a specific answer based upon the information you have provided. What you should know is that a divorce can take more than or less than six months, however, one can not be restored to the status of a single person until at least six months has gone by from the date of service of the petition (regular dissolution), or date of filing if you are talking about a "Summary Dissolution".

As to your particular circumstances and issues, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
