Legal Question in Family Law in California

Divorce for a marriage registered in India

Hello,

I would like to know if it is allowed to obtain divorce in Unites States for a marriage that is registered in India. If so, is it acceptable by the Indian constitution?

What is the typical procedure followed? How long does the procedure typically take?

File in the county where the parties live. Does your spouse still live in India? Contact me directly.

A divorce is properly granted in the county, state and country of the residence of the party requesting the divorce. In California you must be a resident of the State for six months and the county for three months. If divorces are recognized in India then a California divorce should be recognized, but to be sure you should check with an attorney in India. I have never heard that they are not recognized. Good Luck, Pat McCrary
