Legal Question in Family Law in California

Divorce After 3.5 months

My wife of 3.5 months has brought up her dissatisfaction with our marriage. We had been considering a move out of state and thus have a house (in my name only) for sale. I have also been looking at businesses to buy. What would be the impact on community property if a sale of the house goes through before we file a legal seperation? What are my options to protect my assets, such as my house? We did not sign a pre-nup and she has no assets of her own.

Re: Divorce After 3.5 months

Presumptively the house remains your separate property. You should start immediately to retain an attorney to protect your property and file for the dissolution otherwise you jeopardize the status of any property you acquire. Pat McCrary
