Legal Question in Family Law in California
Divorce Paper Rejection
My brother received a rejection back from the court saying matter needs to be set for hearing. They have 3 kids, two of them living with him, she is not fit but trying to get her MOM to have custody of the kids and she is seeking alimony. How can we get him to get a divorce, get full custody and get a restraining order against this unfit mother? Married 10 1/2 years.

Re: Divorce Paper Rejection
This is not a question that can be simply answered. If there is not an OSC on calendar, he should file one. Or, he can file an At Issue Memorandum if other criteria are met. If I was engaging in a custody battle, I would retain an attorney.
