Legal Question in Family Law in California

Divorce Paper Rejection

My brother received a rejection back from the court saying matter needs to be set for hearing. They have 3 kids, two of them living with him, she is not fit but trying to get her MOM to have custody of the kids and she is seeking alimony. How can we get him to get a divorce, get full custody and get a restraining order against this unfit mother? Married 10 1/2 years.
