Legal Question in Family Law in California

Divorce Papers not countersigned

The man I'm living with says he is totally and legally divorced.. but.. she has signed the divoce papers but he never countersigned the papers. He needs to go to the valley where they are filed and get them...he just hasen't done it yet. Is he really divorced?

My concern is; his business is about to take off - he has been working on it for the past 5 years - would his ex have any claim to the money he will be coming into? They have been apart for 7 years.

Is he legally divorced without having countersigend the papers?

Re: Divorce Papers not countersigned

He could have obtained a bifurcated judgment as to status only. The only way to find out for sure is to go look at his papers.

The ex-wife is not going to have any claim to the business if he started the business after they separated.
