Legal Question in Family Law in California

After divorce papers are filed

On Thursday I was served divorce papers. On the following Sunday we talked about putting the divorce on hold until after I have surgary in about month. Is this going to be legal or a problem?

You should either get a written agreement to give you an extension of time to answer or you should file a response. The medical insurance that is covering you during the marriage will continue to cover you until the marriage is dissolved. It is common for the date of the dissolving the marriage to be delayed for several months to insure that both parties are covered for medical procedures.

In a general sense, once you have been served you have 30 days to file your response. This time frame can be extended by the parties, and confirmation of the extension should be in writing.
