Legal Question in Family Law in California

My divorce is pending the hold up of my husband to file his asset disclosure. I filed mine months ago and was told I can't file judgement until he files his disclosure. He's stalling to buy time hoping to get back into graces. Hardy har-har.

Question, is there a statute of limitations by which he needs to file this? I don't want this divorce to drag on forever.

Actually, he does not file the asset disclosure. He needs to disclose assets to you, and file proof that he disclosed those assets to you. It is known as a Declaration regarding Service of Final Declaration of Disclosure. The same form is used for the preliminary and the final.

If he failed to serve a Declaration of Disclosure, and you complied and served your declaration of disclosure, then you need to request the declaration of disclosure. If he still refuses, then you can either move to compel a response, or file a motion for an order preventing him from presenting evidence on issue that would have been covered in the declaration of disclosure.
