Legal Question in Family Law in California

Divorce and Pets

I have two grown dogs. I am currently getting a divorce and he left me the dogs. I do not want the dogs and never wanted the dogs. I never had anything to do with getting the dogs. Now I have them and have to feed them pick up there dog crap and but their food and flea products. I'm tired of covering up there holes they dig, and I'm worried when they get out for fear they may bite someone. When I tell him to come get them he says I can't get rid of them until after the divorce is fonal or I'm in contempt of court. What can I do???

Re: Divorce and Pets

I would send him a letter telling him that you have decided to give him the dogs as part of the property settlement and he has one week to pick them up or they are going to the pound. Under the standard restraining orders you are allowed to dispose of property in the usual course of business. getting rid of dogs that are an unnecessary expense or causing damage to property would not violate the standard restraining orders in my opinion.
