Legal Question in Family Law in California

divorce procedures

My wife and I filed three years ago.We both agreed on all terms that was fair for both of us.She went through some addiction problems since then,and her lawyer was unable to get ahold of her.Now that he has got in touch with her he wants her to ask for more compensation.She was in disagreement and terminated his services. Since we both have file already what is the next step we can take to make this divorce complete? Thanks , DRU

If all the required paperwork is completed, you can take it into court yourself, go before the judge and complete the process. You did not mention if you still have your attorney. If so, speak with him or you can contact us and we'll tell you if everything is done or if you have other needs.

Given that you did not state what "papers" were filed, and the fact that the county involved is being kept secret, you will get a general answer.

Discoclosure docuemtns must be prepared and exchanged; a settlement agreement prepared, signed and notarized; and that along with a Judgment, Notice of Entry of judgm,ent and a dec.,foir an unbcobntested Dissolution, preppared, signed and filed with the court, may result in it all being done by mail. Too bad you didn't give much in the way of information.

Assuming you have exchanged the required financial information (Declarations of Disclosure--the information MUST be current) and you have prepared a marital settlement agreement that describes how all property, custody, etc. issues are to be resolved, there is probably no reason that you couldn't finish your divorce very quickly. Basically, you need to satisfy the judge that each of you knows what you have and that your agreement is fair and complete.
