divorce in san diego , ca,

couple married 18 yrs. have each own business. have split bills 50/50. she has saved in an ira for her retirement. he has not. is he entitled to any of her ira?

You have a misunderstanding as to community property law. The businesses to some extent and the income from them are community property. The IRA is a minor issue. For a protection of your rights call me directly.

The IRA is community property to the extent that it was contributed to during the marriage. The businesses, also have a community property interest. You should talk to an attorney on this as there are substantial issues concerning community property. Good Luck, Pat McCrary
