Legal Question in Family Law in California

Divorce settlement

The judge has made his ruling. My husband will buy me out of our house. I will pay $35,000 of the bills, my husband $25,000. The money from sale of house was put into a trust fund. But the fund only has my lawyer and my husband's lawyers name. Now they won't release my half of money to me. She says they have to settle bills first and my husband is now claiming he has extra bills that I need to pay. Why can't the money from the bills I owe be taken out of my half of the house money and the rest given to me? Also I want to fire my lawyer, but she says I can't and that it would make getting my money take longer. What can I do?

Re: Divorce settlement

You have the right to change attorneys at any time. However, it may slow the process and will cost additional attorney fees for the new attorney to review the file and get up to speed on the case. The amount of funds in the trust account in excess of the amount claimed due should be released to you. You could file a motion requesting that the court order the funds released to you.
