Divorce

I have a short term marriage (12 months) with no community property or children. Can i prepare my divorce papers to ask the court to order my spouse to leave the apartment...

She refuses to go now, i have paid the rent and maintained my lease for 12 years and i don't want to be the one to move out...

Sure you can. Prepare temporary orders to be filed with your petition (Form FL-305 attachment to order to show cause) and fill out the information for property control. You state that she will not leave...is it because she has no where to go? Or could she find a new residence with sufficient time? I think you want to find out all of the information that you can from her on this subject.
