In a divorce situation, at what age can a child decide which parent they want to live with ?

18. Before that it is up to the parents to stipulate, or the judge to decide what is in the best interests of the minor child. At age 14 the child has a relatively new statutory right to address the court and say what they want, but the judge still decides based on all the evidence. Younger than 14 it is up to the court whether to hear from the child.
