Legal Question in Family Law in California

Help me!!!

I want a divorce, my spouse does not.. She moved out 4 months ago. The house is in my name prior to marriage. All the equity is cashed out and gone. We have no kids, all the property is divided/able. Easiest and quickest way to be free?

There is no easy\quick way out when one spouse wants out and the other does not. There may be a community property interest in and to your separate real property.

If both parties are willing to cooperate then it is much easier to close out this matter. However, because one spouse does not want the divorce, the matter must run its course. You should be aware that a) Regarding getting a divorce,it doesn't matter if your spouse doesn't agree, and b) despite the fact that the house was yours prior to marriage, there may still be a community property interest in the house. You should speak with an attorney for assistance.
