Is it possible to get a divorce in the state of california even if one spouse of the party will not agree to it

Yes. California is a no fault divorce state. If one person wants a divorce they can file and if the other person does not respond a default judgment can be entered after a six month waiting period. There are a lot of issues that must be addressed with any dissolution but the simple answer to your question is that one party wanting to stay married will not prevent the party that wants a divorce from getting a divorce.
