I am thinking of separating from my wife. I am concerned about her taking our daughter out of the country because she has relatives who live in Canada. How do I go about getting a restraining order so my wife can only keep our daughter within the County of Los Angeles. Do we need to be legally separated and can this be done quickly. Also does a lawyer need to file for the restraining order?

When you file the petition for dissolution there are temporary restraining orders that you must follow. These restraining orders apply to her once she has been served. One of the restraining orders is that you are both ordered not to remove the children from the state of California without the consent of the other parent or a court order.
