I thoughtI was divorcedin 1994. I receivedpapers from thecourt that year and filed them away thinking I was through. I remarriedin 2007 and have just heard from my ex-husband that the divorcein fact wasnot final.We are in California. We are going to the courthouse next week to fill o ut the papers are refile. Can I go to jail for this? Should I tellthe clerk at the courthouse I am remarried? Can my current husband and myself just get married again in a cilvilceremony?

First check the court file and then consult with an attorney. You may divorced and the ex is harassing you. Even if your divorce was not final you may be able to get a court order granting the divorce nunc pro tunc, that is the order entered now would go back in time and become affective at a time prior to you current marriage. I have not heard of any case where the party in your position has been charged with criminal conduct.
