Divorce Time Limit Question
I live in CA but in a different county than my husband. He filed for divorce in October of 2000, but he has refused to complete the divorce process (ie- finalization, or default). I have tried on several ocassions to file a Response or Default myself, but I continue to get my forms back in the mail with various reasons for denial. Is there a time limit from the date of filing to when the application ''expires''? I am hoping to be able to refile in my county in order to speed up the divorce process.

I would not refile in another county because that would create a bigger mess and it would not resolve the problem. the california rules of procedure and court are the same in each county so you probably need to stick with that case and then speak to a family law facilitator.

In a general sense, you can not take default against yourself, but you can file a response and pursue the matter to trial. Sounds like you need some help with the paperwork. We offer paralegal support services that are attorney supervised.
