Re: Divorce

I am sorry to hear about your divorce. However, it may be positive if the two of you can agree on the financial aspects of the divorce.

In instituting a divorce, you or your husband will need to file a Summons, and Income and Expense Declaration, and a Petition for Dissolution of Marriage. You will have to have him served with a copy and then file the Proof of Service with the Court.

While the divorce is in process, you may have the option of going into court and asking the judge for temporary support orders or child support/custody/visitation orders if there are children. Additionally, there may even be a way to get him to pay attorneys fees if his earnings are significantly greater than yours.

Simple divorces in California generally take 6 months because of the residency requirement.

This is a very simplified overview of the process. If you have any further questions, I would be happy to meet with you in my Orange County office for a free consult.
