Legal Question in Family Law in California

divorce

My wife and are going thru a divorce..We both used to live in Southern Ca but I have since moved back to Illinois and she filed for divorce in Orange County, CA back last May'04. She filed pro se as she is representin herself as she is a legal secretary I am guessing she is also getting legal advice from the attorney she works for. I do not have nor can afford an attorney and since my wife is a legal secretary and in law school, she does have has me at a considerable disadvantage financially & otherwise. I do not know why it is taking so long for the divorce as I am not fighting it and agreed to all her terms and there are no finacial/children or assets involved as we were married less than 3 months before seperation. She seems to be stalling for whatever reason, so how can I expedite this process and protect my interests as it is almost a year since she filed for div and the Orange County family courts states that they are waiting on her to file a final paper/motion of some sort. I cannot contact her in any manner as she has forbidden me to do so and like I stated I do not have nor can I afford an attorney nor do I have a go between? I just want the divorce to be finalized so that I can move on with my life .

If there is no court order which says you can not contact her then if I were you I would call her and get this matter done with. Given your description of the matter this should have been finalized along time ago. Without you getting involved this could continue for many, many more months and if no action is taken the court could dismiss the divorce matter and that would put you back at square one.

If you feel that you can not call her for some reason then you should find an attorney who is willing to call her and send her a letter requesting that she move on this matter.
