Legal Question in Family Law in California

Divorce

My wife and I moved to California in Feb. of this year. She just moved back to Florida(our previous residence) and I would like to file for a divorce. How do I get started?

Re: Divorce

Start by filing a Petition for Dissolution of Marriage and have her served as soon as possible. I'm not currently in the office, but if you'd like my help then call my office. Nancy will give you my cell phone number. You can call that number any time.

Sincerely,

Phillip C. Lemmons

Re: Divorce

You can file for divorce in California so long as you have lived here for at least 6 months. Your wife can file for divorce in Florida once she has lived there for the time period required by Florida law. I am not sure what the time period is in Florida, but it is as short as 3 months in some states. The law follows the first in time, first in right rule. So the person who files first will get jurisdiction in their state.
