I want a divorce. What if my wife won't sign the divorce papers what would happen?

She is not required to sign the divorce papers. All you must do is serve the petition on your spouse and if she fails to file an answer within 30 days of service ,you can take her default.

I agree with Ms. Kock. California has a no fault divorce system, called dissolution of marriage that has been in place since 1975. Forget what you see on television or the movies, all it takes is one spouse to file and the other spouse does not have to sign anything for the divorce to take place.
