Legal Question in Family Law in California

I am going through a divorce with my wife, and she is talking about trying to take the kids and move out of state back to where her family is. What are the chances the court will award her custody to allow her to do that? There is no history of abuse or anything that would sway the court to think the kids are better off with one of us vs the other, and I am seeking joint custody.

The answer to this question is driven by a number of facts missing from your question. The placement of the children and their custodial plan is designed by the court using the 'children's best interests' standard. Many factors may justify placement with either father or mother. Your best option is to meet with an experienced family law attorney to explore your legal options.
