Legal Question in Family Law in California
My divorce had been going on for 3 years (uncooperative husband). I had a Pro Bono attorney. My attorney accepted a settlement my husband wrote without my knowledge or consent. He lied to me what was in the settlement.. For example, My husband invested several hundred thousand dollars of my retirement to buy and pay expenses for his LLC. I didn't want to own the medical building (LLC) but wanted my investment back upon the sale of the LLC. My attorney said I that was not possible. I would have to pay my share of mortgage, taxes and upkeep on the building (LLC) and I had no money, so the LLC was given my husband and I am without any retirement money. I am 58. I learned later I could have gotten my investment back without owning part of the building.
I signed the settlement because of this and other major lies my attorney told me.
Can I get the agreement overturned? I got nothing in my divorce. My husband got his practice (a corp) the LLC, all my personal property and all the community property. My attorney said my personal property was 'garbage'. He never saw it...It was a 30 year domestic abuse marriage.
What should I do?
1 Answer from Attorneys
You need to do three things: (1) hire an attorney to move to set aside the judgment if it's not too late; (2) find an attorney who does Legal Malpractice; and (3) file a complaint against your attorney with the State Bar.
