Legal Question in Family Law in California

divorce/alimony

married for 26 yrs. filed for divorce 4 yrs. ago. He filed for a fee waiver,with the court being he lost job. and no income. My atty. suggested being lost job drinking problem he had no income I should not go after alimony . One month 2009 ago we are notified from my atty. the fee waiver was not granted. So x-husband paid the money to court.My question why did this take so long I feel my atty should of done more for me now I am not employed , he is receiving his retirement for S.S. and I am trying to make a house payment from workers comp. Can I go back to court and request alimony. And why did it take 4 years for this. I had asked atty. if I could go back and ask for alimony they said, no but in the long run divorce was not final when i asked that question. Any ideas.

If your divorce is not complete you can ask for temporary support. If the judgment is finalized you have to look at the terms of your divorce decree to determine whether spousal support is allowable.
