Legal Question in Family Law in California

Divorce/Child custody

Hi, I have been having marital problems with my wife for a while and 2 months ago she told me that we should try again. She told me she got orders to Japan(she's in the Navy) and she wanted me to leave my job and come with her to live in Japan. At first I didn't really want to but she finally convinced me so I left my job and came with my 3 year old son to Japan. Almost immediately she turned again(within 2 days) and after 2 weeks of her not talking to me told me she was going to divorce me. She told me she only wanted for me to bring my son to Japan then send me back. I don't know what to do and what will happen to my son? He is a US citizen, my wife is still a mexican citizen in the process of getting her citizenship through the Navy. How can I bring my son back to the states with me? She wants to keep him here and I want to take him back to the states(San Diego). WHat can I do? I left my job caused she told me to leave it and come to Japan with her, and now she's leaving me. She wants to get back with her ex-boyfriend(I have some proof, I have some of the e-mails) What do I do? What can happen? Please help.

Re: Divorce/Child custody

Unless she has a court prohibiting you from taking the child back to the U. S. you can go to the airport and fly back to the U. S. Once you get back to the U. S. file a petition for dissolution and a custody order.

Re: Divorce/Child custody

You will want to get your case heard in the U.S. Consult with an attorney right away. I think you would want to go to court in the jurisdiction where you were living with your son and get an emergency custody order, and then have it enforced in Japan.
