Legal Question in Family Law in California
Divorce,child support and child visitation
My fiancee and I want to live together but I would like to know what could happen to him since he is still married not living with her and has not filed for divorce yet,? he is afraid he might go to jail for moving in with me. Also what he should do to get child visitations in a faster way, what he needs to do? Well, he has 2 kids with his still wife, she always tells him he wont be able to see the kids because he is going out with me and doesnt want them to have any contact with me and since they dont havent done anything legally she is playing with him. Well he is so nice that he believes everything she tells him.So, I would like to know if he could go to jail is he lives with me? and What he needs to do to get to visit his kids without having her doing whatever she wants. Or simply what is better for us so we can finally be happy.

Re: Divorce, child support and child visitation
First, nothing will happen to him if he moves in with you.
Second, his wife does not have the final say over visitation. He should file a Petition for Dissolution and an Order to Show Cause for visitation, etc., so that he can see his kids.
It's none of her business if he is seeing you.
