Legal Question in Family Law in California
I was divorced in 2005. We agreed I was to be paid 100.000 upon the sale of our home, to reimburse me for moneys I paid. As of this date, he has held onto the home. It has sat empty since. and thus damaged severely, he has had many offers for the home and has not sold it. I have pleaded him that this has gone on too long. I do have the agreement. He does not deny this agreement. Just has not followed thru. This needs to be resolved. Would I be entitled to interest on this money? I have been told I will need to court to either get him to satisfy this agreement or take possession of this home. That at one time worth quite a bit of money. Now that I hear its been severely damaged. I am to retire soon and will be leaving California. Thank you for any guidance in this matter

Mismanagement of the condition of the house by your ex may be a breach of his fiduciary duty. If the court makes that determination, you may be entitled to attorney's fees for returning to court. You should also be entitled to the agreed buy out value of $100,000 set forth in your marital judgment.
