Legal Question in Family Law in California
I have been divorced for approximately two years. I am required to pay my ex-wife alimony. I am having a tough time making payments. My pay has recently been cut 25%. My new wife and I were in the process of trying to conceive a child. This requires fertility treatment. Once she has a baby we didn't want her to work for the first five or six years of the childs life. Also, my ex-wife was supposed to try and better herself and get on her own feet; she had three years to do this. Plus she is now living with her boyfriend who owns his own business and makes approximately $130,000 a year. Will I be able to terminate alimony?
1 Answer from Attorneys
You are the ideal individual that needs the assistance of counsel. Long term spousal support can be terminated or modified. A co-cohabitant can be a reason to lower or zero out spousal support. The fact your income also dropped 25% ( I am assuming not voluntarily) will also factor in as well. This is a very fact driven and law driven case. You really should hire an attorney who can walk you through the process and advocate on your behalf.
