Legal Question in Family Law in California
divorced, now how do i collect
I have been divorced for over 10 years. The only thing I asked for in my divorce was 1/2 of my ex's retirement for the 23 years we were married. It was granted. Now how do I apply for this money? He has not retired yet, but people inform me I can still get what is owed to me now. Is this true. My ex is an Ironworker and belongs to Ironworkers Union Local 70. Please advise me what to do next.
Thank you so much.

You need to file a "joinder" and "QDRO". I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

as far as california community property laws go, you definitely would be entitled to receiving your share of the community property pension, and further, you would not have to WAIT until your ex's pension matures, especially since you have a vested interest in this retirement fund and the court has already shown your entitlement. therefore, you should definitely retain an attorney to file the appropriate paperwork on your behalf and represent your interests asap, especially if time is of the essence that you secure some or all of the funds you are entitled to. feel free to email me directly today for additional assistance and/or how to get your funds as swiftly as possible.
