Legal Question in Family Law in California
I am divorced but I haven't yet settled with my x-husband. Well, my x-husband and I have dated for close to 1 yr. and we have a 6 yr old daughter as well. We all three just recently moved from San Diego, Ca to Woodside, Ca. and have plans to soon remarry. Well, I asked my xhusband to write something up stating that if things don't work out between us that he wouldn't fight to keep our daughter at Woodside since I'd move back to San Diego and preferably with our only child as well (daughter). He's willing to write something up to try to save on attorney fees...would the court honor the signed paper with his agreement to not fight to keep our daughter? Or would a attorney need to do it so it would be valid for the courts? Does it need to be notarized as well?

It is commendable that you're trying to work something out between each other as parents in the event that the marital relationship fails. To best structure any agreement, you should meet with an experienced family law attorney and have that individual assist you on drafting some kind of agreement. The viability of that agreement has everything to do with how well it's written and the circumstances surrounding your family situation if your marital relationship breaks up.
