Legal Question in Family Law in California
I was divorced 12 years ago. The house has stayed in both of our names. I was never in a position to buy out my ex-husband. I am needing to re-finance (lower rate/buy out). We are having a problem coming up with an agrreable price. Am I able to count the payments I have made against the house to my credit. What would recommend in this case? My income is 30,000.00 and his 130,000.00

Ms. Kock is absolutely correct and I agree with her completely. You will need an experienced family law attorney regarding this issue. The Martial Settlement Agreement should provide the terms and conditions under which the property will be handled. If it doesn't then there is more reason for an attorney.
