divorced/child custody rights

Can you be sued, if you're a divorced parent, sharing custody between you and your ex, but you chose to avoid answering his calls (the only means of him keeping in touch with his child). Is there any way that he can take full custody of my son and away from me????

He could accuse you of kidnapping and contempt of court, and if successful, the court could give him sole physical custody.

If you have a good reason to prevent phone access, you should apply for an ex parte court order.

If you do not allow access to the child and do not want to exercise joint custody of the child with the father, absent a good reason, the court can and probably will take the child from you to see of the father can do a better job of allowing you access to the child. Good Luck, Pat McCrary
