Can I, as a male, get my last name taken from my ex-wife or is it only at her discretion to not carry the last name?

That is a good question. I would say you can. Although there is no statute allowing such, I would argue that in light of recent California Supreme Court decisions indicating "Our statutes are not gender specific" you should have a constitutional right to take back your name. If she can, why can't you?
