Legal Question in Family Law in California

Divorce-los angeles county, ca

My husband filed for our divorce in 1996 and a default was issued for me in 1997. He never had the divorce finalized, nor did he act on the default entry in anyway. To my knowledge we are only legally separated as of 1997. We have one child together and have been handling custody issues through conciliation court. My question is do i need to start the divorce filing all over again or do we just have the old case finalized? If we need to re-file can we just attach a copy of our custody agreement to the new filing?

If the old case has not been dismissed then you can proceed to judgment under the old case. Go to the courthouse and pull the file to see if the case has been dismissed. If you are not sure ask a clerk. Good Luck, Pat McCrary
