Divorce/Seperation

I live in ca., but I'm from TX and have family there. I am thinking of separating and possibly divorcing my husband. We have a child together. What do i have to do to ensure that i can leave the state and take the child with me? If I decide to divorce my husband, would it be better to file in TX rather than CA?

If your husband doesn't mind if you leave CA with the child, then go ahead and move and file in TX. Get something from him in writing that it's okay with him for you to move and take the child.

If it's not okay with him, then I would not move until I had gone to court in CA and obtained custody and a move-away order.
