Legal Question in Family Law in California

divorcing an attorney

My spouse has practiced law for approx. 30 yrs. After 12 yrs of marriage and working with him as his assistant we are divorcing. He wishes to keep our residence and insists the law practice is not community property. Am I entitled to half of each - or, can I release my half of the practice and keep the residence?

Re: divorcing an attorney

If your name is on the house then you have a community property interest. The practice may be partially community property and partially his separate property. This is a very complex question and could only be answered after much more information is given. You will almost certainly need the advice and representation of a family law attorney.
