Legal Question in Family Law in California

divorcing illegal immigrant

When I married I did not know he was illegal. We never lived together because two days after wedding he was picked up by border patrol. He was given voluntary deportation. He never left country. I do not know if he has an address. My baby has my last name and he is not on the birth certificate. How do I easily divorce him if there is no place to send the papers? And do I already have sole custody of my baby if she lives with me and he is not listed on the birth certificate?

Re: divorcing illegal immigrant

You have sole custody by the facts but not by the law. You can file a dissolutin by publishing the summons or posting the summons if you are low income. You should move quickly to avoid problems. Good Luck, Pat McCrary
