i was married and i got married again not knowing if my husband was alive or dead.. however i never lived with or slept with the second guy. now my i have found out that my husband has died just three years ago and i may not be eligible for social security is there some way i can correct this mistake... i believe the law is that if you re- marry that you can not collect. no matter i still want to divorce or anul the second guy because he were never actually a couple.. it has been over 5 years i believe.... A marriage that is solomenized while one of the parties is married to another person the marriage is viod. File a petition to declare your second marriage void and the file your application for social security. Honestly answer all of the questions. There are attorneys that specialize in social security claims.
