You are going to get at least $20,000 for your share of the house, you ought to be able to find a lawyer who will agree to be paid from this money. Maybe a lawyer can get you $50,000 or even more. Hiring a lawyer in this situation might well save you, not cost you. Call one and make an appointment.

Re: divorse, community propery

This is a case in which you really MUST have an attorney to protect your rights. When you state that you can't afford an attorney, the real fact of the matter is that you can't afford not to have an attorney.

Presuming the house in question is community property, then you have a right to 50% of the equity in the house. You have this right regardless of whether you worked or not during the marriage.

You may also have other rights, or be entitled to other property or support from your husband. Please disregard what your husband is telling you - he is NOT acting in your best interest.

I repeat, please contact an attorney to protect you in this matter - you'll be glad you did! The attorney may be able to get legal fees from the house or even possibly, depending on the circumstances, from your husband.

If this office can be of any assistance, please feel free to call us.
