Legal Question in Family Law in California

DNA Testing

I am currently going through a custody battle with my ex-boyfriend. However, there may be chance that it is not his. I want to do a DNA test to conferm it. Should I continue with my custody battle and let the courts finalize everything? Or should I consult a lawyer to have a DNA test done. I prefer to just have one done with out a lawyer. Will the courts order another one if he is not the dad, or will go by the results that I have obtained.

Re: DNA Testing

Sounds like you need counsel to handle both matters.

Re: DNA Testing

Considering the importance of the child and his/her relationship with the father,It is always better to ensure certainty in determination of the father's identity. I would advise that if you have not already filed a Paternity Action you should do so and request genetic testing of you, the child and your boyfriend. Once there has been a proper determination, you may then properly proceed with custody/visitation issues and require that the father pay guideline child support. If you can afford it, I would strongly recommend that you utilize the services of an attorney.

Good Luck!
