Legal Question in Family Law in California

My Dog Back?

I am going through a divorce and my ex has my dog that I had

bought before we were married. He claims that it is his and wants

the papers on the dog because he bread the dog and had

puppies. The papers are in my name and my name only with my

maiden name on them. How do I get the dog back? What are the

necessary steps for me to take?

Re: My Dog Back?

Pets are a kind of property in CA. Therefore, if you and your ex cannot agree, you need to obtain a judgment from the court identifying the dog as your property. Your argument would be that the dog is your seperate property because it was obtained before your marriage. You may also be able to arrange a shared custody situation in the meantime - either through negotiating with your ex or by going into court.
