in a domestic dispute / break up who has rights to stay in the house

Without more information ,it is not possible to provide a fact specific answer. If you are suggesting that there is domestic violence, then the perpetrator of the violence can be ordered to leave the residence. If there is no threat of harm, both parties have a right to cohabit in the residence until such time the property is divided .
